What Should You Check Before Buying a Las Vegas Home That's Already a Short-Term Rental?
Homes sold with an existing short-term rental can look like a shortcut: furnished, booked and already producing income. But the license does not automatically come with the house, and a case that started under a previous owner can still become your problem. If you are comparing that path to other strategies, our look at whether now is a good time to buy investment property in Las Vegas covers the broader market numbers investors are working with.
What Happened in the $41,500 Las Vegas Case?
According to FOX5 Vegas, an investor bought a Las Vegas home in August 2025 after seeing it listed as an attractive property with steady monthly income from a short-term rental that was already running, with a tenant on an ongoing lease. What the buyer did not know was that the City of Las Vegas had opened a code enforcement case against the rental in September 2024, after a complaint.
City documents cited in the report show code enforcement calculated $41,500 in fines at $500 per day for more than 80 booked guest days. The owner’s attorney argues that the buyer did not start the unlicensed use, but purchased a home where it was already operating and was marketed as lawful income, and has asked the city to reduce the fine. The matter is scheduled for a City Council hearing in late October.
Are Short-Term Rentals Legal in Las Vegas?
Yes, but only with a license. Short-term rentals are allowed in the City of Las Vegas when they are licensed and follow city regulations, a point covered by the Las Vegas Review-Journal in its reporting on earlier enforcement cases. The city’s penalties have been significant: the Review-Journal reported that the City Council upheld a $55,000 penalty in 2024, again at $500 per day, and noted that the city had imposed a $180,000 penalty on another homeowner earlier that year. In the $55,000 case, council members discussed a reduction but stayed with the staff recommendation for consistency.
Jurisdiction matters too. A “Las Vegas” mailing address can sit inside the City of Las Vegas or in unincorporated Clark County, and Henderson and North Las Vegas each have their own rules. Our breakdown of what changed in Clark County’s short-term rental rules in 2026 explains the county side, including the ongoing litigation.

Build these checks into your offer and your due diligence period:
- Which jurisdiction is it in? Confirm whether the parcel is in the City of Las Vegas, unincorporated Clark County, Henderson or North Las Vegas. The answer decides which licensing rules apply.
- Is there a current short-term rental license? Ask the seller for the license number in writing, then confirm it directly with the issuing jurisdiction. Do not rely on a listing description or a platform badge.
- Can the license be transferred or renewed? Ask the licensing office how a sale affects it, and whether you would need to apply as a new operator.
- Are there open code enforcement cases or complaints? The case in the FOX5 report began almost a year before the sale. Ask the seller to disclose any notices, and ask the city or county whether a case is open on the address.
- Who is actually operating the rental? If a tenant on a lease is running it, review that lease carefully. A tenant hosting guests can create exposure for the owner.
- Does the HOA allow it? Many associations restrict or ban short-term rentals regardless of what the city or county permits.
How Should You Value Advertised Airbnb Income?
Conservatively. If the rental is not licensed, the advertised income may not be legally repeatable, so underwrite the property as a long-term rental first and treat any short-term income as upside only after licensing is confirmed. If the numbers only work with short-term income, that is a reason to slow down, not speed up. Many owners weighing this decision are running the same comparison from the other side, as our guide to selling a Las Vegas home versus turning it into a short-term rental explains.
Who Can Help You Check All of This?
An experienced buyer’s agent can make sure the right questions go into the offer and due diligence timeline, and a real estate attorney can review licensing, lease and enforcement issues. Remember that the listing side represents the seller, which is why investors benefit from having their own buyer’s agent in Las Vegas when a property’s value depends on claims like rental income.

Frequently asked questions
Are short-term rentals legal in Las Vegas?
Yes, short-term rentals are allowed in the City of Las Vegas when they are licensed and follow city regulations. Unincorporated Clark County, Henderson and North Las Vegas each have their own separate rules.
What is the fine for an unlicensed short-term rental in Las Vegas?
Recent City of Las Vegas cases have been calculated at $500 per day. FOX5 Vegas reported a $41,500 fine in October 2026, and the Las Vegas Review-Journal reported penalties of $55,000 and $180,000 in 2024.
Can I be fined for a short-term rental the previous owner was running?
In the case FOX5 Vegas reported, a buyer who purchased a home with an existing unlicensed rental now faces $41,500 in city fines and is asking the City Council to reduce them. Check for open enforcement cases before you buy, and talk to an attorney about your specific situation.
How do I check if a Las Vegas short-term rental is licensed?
Get the license number from the seller in writing and confirm it with the jurisdiction that issued it, whether that is the City of Las Vegas, Clark County, Henderson or North Las Vegas. Also ask whether the license can be transferred or renewed after a sale.
Should I trust the rental income in a listing?
Treat it as a claim to verify. If the rental is not properly licensed, that income may not continue, so underwrite the property as a long-term rental first.
